Additional Third Party Terms

These terms (“Additional Third Party Terms”) describe the terms and conditions for Third-Party Software that may be included in Chainguard Products, in addition to any other license terms applicable thereto (including but not limited to any license terms identified in the documentation and/or the software bill of materials) and as set forth in the Agreement.  To the extent Customer purchases or uses any of the Chainguard Containers listed below, Customer is subject to the additional terms and conditions. The Licensor listed herein is the maintainer and/or owner of the applicable Third-Party Software. Certain Chainguard Contrainers may require Customer to hold a valid license or equivalent use rights from the Licensor directly before Customer can use the applicable Chainguard Container and Licensor may choose to enforce such rights through use of a license key or equivalent. In the event Customer’s or Chainguard’s license to the Third-Party Software expires for any reason, Chainguard may immediately suspend or terminate Customer's access to the affected Chainguard Container and Customer shall be entitled to a substantially equivalent Product  for the remainder of the then applicable Order Subscription Term. Any capitalized terms not defined herein shall have the definition ascribed thereto in Chainguard’s MSLA, and as may updated from time-to-time, unless a separate binding written agreement is currently in effect by and between Customer and Chainguard, governing the provision of Chainguard’s products and services (“Agreement”).
