Additional Third Party Terms

These terms (“Additional Third Party Terms”) describe terms and conditions for Third Party Software that may be included in Chainguard Products, in addition to any other license terms applicable thereto and as set forth in the Agreement.  Any capitalized terms not defined herein shall have the definition ascribed thereto in Chainguard’s MSLA, and as may updated from time-to-time, unless a separate binding written agreement is currently in effect by and between Customer and Chainguard, governing the provision of Chainguard’s products and services (“Agreement”).

1. AZUL

Chainguard’s obligation to provide the Chainguard Containers known as zulu-jdk and zulu-jre (each, “Azul Container”) is conditioned on Customer maintaining an active license and support agreement with Azul Systems, Inc. for Azul Platform Core (“Azul Subscription”) for the duration of any applicable Order.  In the event Customer’s Azul Subscription is terminated for any reason during the Order subscription term, Chainguard may immediately terminate Customer’s access to the Azul Container without penalty or refund.

1. MS ODBC

Microsoft Corporation’s open database connectivity (MS ODBC) software components are subject to the license terms available at https://www.chainguard.dev/legal/software-license-agreement-msodbc. 

1. NVIDIA CUDA

NVIDIA Corporation’s software components are subject to the license terms available at https://www.chainguard.dev/software-license-agreement/nvidia.
